A class action lawsuit was settled with Dillard's department stores for $500,000.00 and substantial remedial relief on behalf of twelve former employees, who were sexually harassed by an assistant store manager in two states.
After receiving complainants from an employee, who complained that the assistant store manager had inappropriately touched her, Dillard's verbally warned and transferred the assistant store manager. Dillard's failed to notify to new store about the assistant store manager's history of sexual harassment allegations. Only after the police were contacted regarding a second incident, where a eighteen year-old high school senior stated she was verbally and physically harassed, did Dillard's terminate the assistant store manager. The EEOC argued that by failing to notify the new store about the assistant store manager's prior sexual harassment allegations, Dillard's permitted its employees to go into harm's way.
